Complying with data protection laws and therefore protecting your personal data is exceptionally important to Atreus GmbH. This privacy notice applies to personal data that we process as part of placing professional staff and managers with customers (“Customers”) in various sectors on the basis of various legal frameworks (“placement services”). In this privacy notice, we would like to explain what data we collect, how we protect these data and what rights you have as a data subject.

The EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) relate to the protection of your personal data. Personal data are all data that can be associated with you as an individual. These include your master data – i.e. your name, address, date of birth, telephone number and your e-mail address etc – and your application documents including CV, certificates and photo and other information related to your application such as preferred areas of employment and remuneration.
We will store and process your personal data only to the extent that and for as long as this is required to perform our contractual services, i.e. for placement services or for legal reasons (record-keeping, reporting and notification requirements, inquiries from law-enforcement authorities or other authorities). We will generally collect these data from you ourselves and will always explain why we are collecting the data. If these data are not collected from you directly, we will also inform you of this where necessary. Where you are required to separately consent to a form of processing, we will obtain your explicit consent beforehand.
We process personal data only where you send us these of your own accord, especially if you send us information on your career path (CV, certificates) or qualifications by e-mail or upload or save these in our portal. We process these personal data in order to perform placement services and thus to fulfill the contract (Article 6 (1) (b) GDPR). If your data are processed on the basis of consent provided separately, they are processed for the purpose specified when giving consent on the basis of Article 6 (1) (a) GDPR.
In addition, we also process activity reports and assessments by Customers in this context.
Only our employees have access to your personal data, in particular CVs, certificates etc, as part of placement services. In addition, on the basis of Article 6 (1) (b) GDPR and Article 6 (1) (f) GDPR, your personal data are sent to our Customers as part of our placement services to fill a vacancy only with your prior consent. We will not pass on your data to third parties unless we are legally obliged to disclose this information, e.g. due to a request from law enforcement authorities or a court order.
To fulfill the contract, we use your personal data for internal comparisons (research) and in order to contact you by phone, e-mail or text message in the event of a project inquiry or vacancy.
Your personal data are provided voluntarily. This is not a statutory or a contractual requirement. Nonetheless, this data must be provided for us to identify suitable positions for you and inform you of these.
We process your personal data together with other companies: AIM GmbH, atrova GmbH, MyHead GmbH (same address) are joint controllers within the meaning of Article 26 GDPR. The main purpose of this joint processing is to operate and maintain the database of candidates and customers.
We have entered into an agreement on the joint processing of your personal data. We will send you the essentials of this agreement upon request.
Your data are processed only within the European Economic Area (EEA). If, in exceptional cases, we transfer your personal data outside the EEA (e.g. to a customer business), we do so only where there are appropriate safeguards for the protection of your personal data (e.g. an adequacy decision by the European Commission or standard data protection clauses). Upon request, we will provide a copy of the guarantees or inform you of where these are available.
If you have given your consent, we will use your e-mail address to send the newsletter featuring the latest information about the Atreus Group (Atreus GmbH, AIM GmbH, Atrova GmbH, myhead GmbH).
Registration for our newsletter uses the double opt-in method. This means that, once you have registered, we send an e-mail to the e-mail address that you specified asking you to confirm that you want us to send you the newsletter. If you do not confirm your registration, it does not become active and you do not receive the newsletter. We also store the time of the registration and confirmation. The purpose of this process is to keep a record of your registration and to be able to trace any misuse of your personal data if needed.
The only information we need to send the newsletter is your e-mail address. After you provide confirmation, we store your e-mail address so that we can send out the newsletter. The legal basis for this is Article 6 (1) sentence 1 (a) GDPR.
You may withdraw your consent to transmission of the newsletter at any time pursuant to Article 7 (3) GDPR and unsubscribe to the newsletter. You may give notice of withdrawal by clicking on the link provided in every newsletter e-mail, by e-mailing firstname.lastname@example.org or by sending a message to the address mentioned in the legal notice.
Please note that we analyze your user behavior during distribution of the newsletter. For analysis purposes, the e-mails that we send contain web beacons and tracking pixels featuring one-pixel image files that are stored on our website. To analyze behavior, we link the contact information specified in item 2 and the web beacons to your e-mail address and an individual ID. The links in the newsletter also contain this ID. We use the data obtained in this manner to create a user profile so that we can tailor the newsletter to your personal interests. We keep track of when you read your newsletter and which newsletter links you click on, and use this information to draw conclusions about your personal interests.
We link this data to your activity on our website. We do not pass this data on to third parties outside the Atreus Group.
You may object to the tracking at any time pursuant to Article 21 GDPR by e-mailing us at email@example.com to give notice. If you do so, technical reasons mean that you will not receive any newsletters for the time being.
The purpose of processing is to optimize the content of the e-mail newsletter and tailoring it your personal interests. The legal basis is “legitimate interest” pursuant to Article 6 (1) (f) GDPR. Your information will be stored for as long as you have subscribed to the newsletter. Once a subscription has been canceled, we store the data anonymously purely for statistical purposes.
Within the scope of contracted data processing, your data is forwarded to Adobe/Marketo Inc., 901 Mariners Island Blvd Suite 500, San Mateo, CA 94404, U.S.A. An appropriate level of data protection is ensured by the use of standard contractual clauses of the EU-Commission (in accordance with Directive 95/46 / EC of the European Parliament and of the Council), which constitute appropriate guarantees in accordance with Article 46 (1) aa GDPR to ensure an appropriate level of data protection in the case of transfers to third countries without an adequacy decision.
When you send personal information to us, we give you the option of sending the information in encrypted format. This encryption safeguards the confidentiality of the data exchange between yourself and our web server, and helps to prevent misuse of the information, e.g. through interception. The encryption method we use is SSL (Secure Sockets Layer). This is a recognized and widely used technology.
If you choose to send us personal data by e-mail, please note that sending data without file encryption or Transport Layer Security (TLS) is not secure and may be read by third parties. For this reason, we recommend using the encryption technologies listed.
In accordance with your rights under Article 15 GDPR, upon request we will of course inform you of whether and, if so, which of your personal data are stored. We constantly strive to ensure that your data are correct and up-to-date. If incorrect information has been stored despite these efforts, please let us know so that we can rectify these immediately in accordance with your right to rectification under Article 16 GDPR.
In addition, you can also exercise your right to object to the processing of your data in accordance with Article 21 GDPR at any time and without stating the reason for doing so. You can also modify or withdraw your consent in full with effect for the future. You can object by sending a letter, an e-mail or a fax to the contracting partner. The only costs you will incur for this are postage costs or costs of sending at existing base rates. We store the information regarding the objection for documentation and verification purposes.
In addition to your rights to information and rectification (see item 9), you also have additional rights regarding the processing of your personal data.
In accordance with the statutory provisions, you are entitled to erasure of your data (Article 17 GDPR), restriction of processing of your data (Article 18 GDPR) and data portability (Article 20 GDPR).
Within the context of the joint processing, Atreus GmbH is responsible for fulfilling your rights. Nonetheless, you remain free to assert your rights with or against other companies in the Atreus Group (AIM GmbH, atrova GmbH, MyHead GmbH).

Without prejudice to any other administrative or judicial remedy, you shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data about you infringes the GDPR.
The supervisory authority with which the complaint has been lodged shall inform the complainant of the progress and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Article 78 GDPR.
