LEGAL STATUS OF INTERIM MANAGERS

For HR departments that also work with interim executives, the introduction of the German 611a BGB regulation has become a real challenge. Accusations of bogus self-employment are never far away. Atreus has found a legally secure solution to the dilemma: the management leasing model.
The Atreus ML (management leasing) model offers both the maximum flexibility that interim managers need for their work, while still being fully integrated into the chain of command.

WHEN TO USE THE ML MODEL

An interim manager takes on a line function. He or she is integrated into the operational organization – e.g. by participating in regular meetings. This means that the interim manager is also part of the chain of command, issuing and receiving instructions. In other words, the interim manager assumes a regular task that is usually performed by permanent managers.
In this case, an accusation could be made that a pseudo-self-employed contractual relationship exists. In this instance, Atreus uses the management leasing contract model. This enables the legally secure transfer of the manager employed by Atreus to the client in accordance with the German Personnel Leasing Act (AÜG).
